If you conduct business in Slovakia, you have likely chosen one of the following approaches:<\/p><ul><li>Operating under a Czech (or other foreign) entity<\/li><li>Operating through branch offices<\/li><li>Operating through subsidiaries<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eaee749 elementor-widget elementor-widget-text-editor\" data-id=\"eaee749\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Which of these cases requires registration? To simplify the legal theory and interpretation \u2013 the registration obligation <strong>applies only to subsidiaries based in Slovakia<\/strong>. Foreign parent companies and branch offices are not subject to registration in Slovakia.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-13c2ca40 elementor-widget elementor-widget-text-editor\" data-id=\"13c2ca40\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h5>For a long time, there was little news regarding Slovakia\u2019s new cybersecurity regulation. While the Czech National Cyber and Information Security Agency regularly presents updates and operates under the scrutiny of experts, Slovakia\u2019s National Security Authority (NB\u00da) has been more reserved in sharing information. It was therefore somewhat surprising when, at the end of November last year, an amendment to Slovakia\u2019s Cybersecurity Act was approved, set to take effect on January 1, 2025. Many Czech companies operate in Slovakia. What practical impact does this legislative shift have on them now that Slovakia has taken the lead in cyber legislation?<\/h5>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ba26ab0 elementor-blockquote--skin-boxed elementor-blockquote--align-center elementor-widget elementor-widget-blockquote\" data-id=\"ba26ab0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"blockquote.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<blockquote class=\"elementor-blockquote\">\n\t\t\t<p class=\"elementor-blockquote__content\">\n\t\t\t\t<b>The criteria for classification are outlined in two annexes to the law. The first lists sectors with a high level of criticality, while the second covers other critical sectors. These categories and the regulated services described within them may sound familiar, as they closely mirror the annexes of the NIS2 Directive. <\/b>\t\t\t<\/p>\n\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-815b75c elementor-widget elementor-widget-text-editor\" data-id=\"815b75c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Company size determination is consistent across the EU, including the Czech Republic (we covered this in more detail in <a title=\"The most common mistakes in self-identification according to the new cyber law\" href=\"https:\/\/cybrela.com\/en\/ni2-the-most-common-mistakes-in-self-identification\/\" target=\"_blank\" rel=\"noopener\">this article, specifically in point 3<\/a>). Register! <\/span><\/strong><\/h2>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1b5284b elementor-widget elementor-widget-text-editor\" data-id=\"1b5284b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>If you conclude that you are a provider of regulated services, <strong>you must register with the Slovak NB\u00da within 60 days<\/strong> of commencing the service (or from the amendment\u2019s effective date). What does this mean in practice?<\/p><p>At the time of writing, Slovakia\u2019s <strong>centralized cybersecurity information system has not yet been launched<\/strong>. This system is intended to serve as the primary communication tool with the Slovak NB\u00da, including registration processes.<\/p><p>Until the portal is operational, companies are instructed to use a <a title=\"Vzory dokumentov\" href=\"https:\/\/www.nbu.gov.sk\/vzory-dokumentov\/\" target=\"_blank\" rel=\"noopener\">form available on the NB\u00da website<\/a>. This form can be submitted via<strong> email or through Slovakia\u2019s electronic mailbox system<\/strong> (like the Czech Republic\u2019s data mailbox system).<\/p><p><span class=\"TextRun SCXW124990238 BCX0\" lang=\"CS-CZ\" xml:lang=\"CS-CZ\" data-contrast=\"auto\"><span class=\"NormalTextRun SCXW124990238 BCX0\">What information do you need for the registration form?\u00a0<\/span><\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c3c9944 elementor-list-item-link-inline elementor-icon-list--layout-traditional elementor-widget elementor-widget-icon-list\" data-id=\"c3c9944\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"icon-list.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul class=\"elementor-icon-list-items\">\n\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<a href=\"https:\/\/nis2.nbu.gov.sk\/indikativna-pomocka-na-urcenie-subjektu-ako-poskytovatela-zakladnej-sluzby\/?csrt=2166212817846169201\" target=\"_blank\" rel=\"noopener\">\n\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-chevron-right\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\">The sector, sub-sector, and type of regulated service provider (as specified in the relevant decree). You may also be preparing to comply with Czech regulations and decrees \u2013 or not. Does this mean you can completely ignore the Slovak legislation?<\/p><p class=\"translation-block\">Even if you are not a regulated entity, Slovak customers may still require you to comply with cybersecurity standards. Cybersecurity clauses are increasingly common in public procurement contracts. In such cases, we recommend reviewing the scope of contractual obligations and negotiating with the contracting authority to limit them to the relevant aspects of the contract.
