a regulation designed to change the way financial institutions manage digital risk in particular.<\/strong>\u00a0<\/h2>\n<p><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fbe838e elementor-widget elementor-widget-text-editor\" data-id=\"fbe838e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><a href=\"https:\/\/data.consilium.europa.eu\/doc\/document\/ST-11051-2020-INIT\/cs\/pdf\" target=\"_blank\" rel=\"noopener\">Digital Operational Resilience Act<\/a>\u00a0\u00a0or <a href=\"https:\/\/cybrela.com\/en\/glossary\/dora\/\" target=\"_blank\" rel=\"noopener\">DORA<\/a>&nbsp;is a binding and comprehensive framework for managing mainly digital risks in the financial sector.\u00a0<\/p>\n<p>It came into force at the beginning of 2023 and entities will have to comply with it\u00a0<span style=\"font-weight: bolder;\">from 17 January 2025.<\/span>.\u00a0\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8679f61 elementor-widget elementor-widget-text-editor\" data-id=\"8679f61\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: bolder;\">Who is affected by DORA?<\/span>\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-93f60d9 elementor-widget elementor-widget-text-editor\" data-id=\"93f60d9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"translation-block\">A wide range of\u00a0<span style=\"font-weight: bolder\">financial institutions<\/span>, such as <b>banks<\/b>, <b>investment firms<\/b>, <b>insurance companies<\/b> or <b>cryptoasset service providers<\/b>, will have to comply with the uniform rules. However, the regulation will also significantly affect <span style=\"font-weight: bolder\">their information technology service providers<\/span>, such as cloud service providers or software developers, etc.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-762fecb elementor-blockquote--skin-boxed elementor-blockquote--align-center elementor-widget elementor-widget-blockquote\" data-id=\"762fecb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"blockquote.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<blockquote class=\"elementor-blockquote\">\n\t\t\t<p class=\"elementor-blockquote__content\">\n\t\t\t\tMore than 22,000 financial entities in the EU are expected to be involved. \t\t\t<\/p>\n\t\t\t\t\t<\/blockquote>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7a9b5bf elementor-widget elementor-widget-text-editor\" data-id=\"7a9b5bf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: bolder;\">Which financial institutions will be affected by DORA?\u00a0<\/span>\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ad94fdc elementor-widget elementor-widget-text-editor\" data-id=\"ad94fdc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"translation-block\"><span style=\"color: var( --e-global-color-text );font-family: var( --e-global-typography-text-font-family ), Sans-serif;font-size: var( --e-global-typography-text-font-size );font-weight: var( --e-global-typography-text-font-weight );letter-spacing: var( --e-global-typography-text-letter-spacing );text-align: var(--text-align)\">The Regulation will bring new obligations for a wide range of financial institutions from January 2025. However, this is only a basic list of the <\/span><strong style=\"color: var( --e-global-color-text );font-family: var( --e-global-typography-text-font-family ), Sans-serif;font-size: var( --e-global-typography-text-font-size );letter-spacing: var( --e-global-typography-text-letter-spacing );text-align: var(--text-align)\">more than 20 different types of financial entities<\/strong><span style=\"color: var( --e-global-color-text );font-family: var( --e-global-typography-text-font-family ), Sans-serif;font-size: var( --e-global-typography-text-font-size );font-weight: var( --e-global-typography-text-font-weight );letter-spacing: var( --e-global-typography-text-letter-spacing );text-align: var(--text-align)\">, that will be subject to the obligations under DORA. \u00a0<\/span><\/p>\n<p class=\"translation-block\">The Regulation also provides for several\u00a0<strong>exceptions.<\/strong>\u00a0These include, for example, insurance intermediaries, reinsurance intermediaries or supplementary insurance intermediaries that are micro, small or medium-sized enterprises. The Regulation will also not apply to occupational pension institutions that operate pension plans with no more than 15 participants in total.  \u00a0<span style=\"color: var( --e-global-color-text );font-family: var( --e-global-typography-text-font-family ), Sans-serif;font-size: var( --e-global-typography-text-font-size );font-weight: var( --e-global-typography-text-font-weight );letter-spacing: var( --e-global-typography-text-letter-spacing );text-align: var(--text-align)\">\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ebdee70 elementor-widget elementor-widget-text-editor\" data-id=\"ebdee70\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>What obligations does DORA impose?<\/strong>\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8eb6113 elementor-tablet-align-start elementor-mobile-align-start elementor-list-item-link-full_width elementor-widget elementor-widget-icon-list\" data-id=\"8eb6113\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"icon-list.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<ul class=\"elementor-icon-list-items\">\n\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-long-arrow-alt-right\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\"><b>risk management<\/b> of Information and communication technology (ICT) <\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-long-arrow-alt-right\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\"><b>management, classification and reporting <\/b>of ICT-related incidents <\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-long-arrow-alt-right\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\"><b>digital operational resilience testing <\/b><i>(checking how well a financial entity is prepared to deal with potential ICT issues) <\/i><\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-long-arrow-alt-right\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\"><b>managing ICT risks associated with third parties <\/b><i>(not only the ICT service providers mentioned above, but also their subcontractors) <\/i><\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t\t\t<li class=\"elementor-icon-list-item\">\n\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-icon\">\n\t\t\t\t\t\t\t<i aria-hidden=\"true\" class=\"fas fa-long-arrow-alt-right\"><\/i>\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-icon-list-text\"><b>information sharing <\/b><\/span>\n\t\t\t\t\t\t\t\t\t<\/li>\n\t\t\t\t\t\t<\/ul>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9cf00c6 elementor-widget elementor-widget-text-editor\" data-id=\"9cf00c6\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"translation-block\"><span style=\"font-weight: bolder\">New and more stringent requirements<\/span> are then introduced in digital operational resilience testing. And let's not forget the <span style=\"font-weight: bolder\">requirements for contracts<\/span> with suppliers of financial entities. They will play a  <\/span><span style=\"color: var( --e-global-color-text );font-family: var( --e-global-typography-text-font-family ), Sans-serif;font-size: var( --e-global-typography-text-font-size );letter-spacing: var( --e-global-typography-text-letter-spacing );text-align: var(--text-align);font-weight: bolder\">key and active role in managing information and communications technology (ICT) risk<\/span> and the overall digital operational resilience strategy. What exactly does the new responsibility for senior management of financial institutions mean?  \u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c3eac18 elementor-widget elementor-widget-text-editor\" data-id=\"c3eac18\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: bold;\">Top management responsibilities\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d9c23fd elementor-widget elementor-widget-text-editor\" data-id=\"d9c23fd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p class=\"translation-block\"><span style=\"color: var( --e-global-color-text );font-family: var( --e-global-typography-text-font-family ), Sans-serif;font-size: var( --e-global-typography-text-font-size );font-weight: var( --e-global-typography-text-font-weight );letter-spacing: var( --e-global-typography-text-letter-spacing );text-align: var(--text-align)\">The DORA regulation emphasises that senior management \u00a0<\/span><span style=\"color: var( --e-global-color-text );font-family: var( --e-global-typography-text-font-family ), Sans-serif;font-size: var( --e-global-typography-text-font-size );letter-spacing: var( --e-global-typography-text-letter-spacing );text-align: var(--text-align);font-weight: bolder\">is responsible for setting and approving all measures related to the ICT risk management framework.<\/span><span style=\"color: var( --e-global-color-text );font-family: var( --e-global-typography-text-font-family ), Sans-serif;font-size: var( --e-global-typography-text-font-size );font-weight: var( --e-global-typography-text-font-weight );letter-spacing: var( --e-global-typography-text-letter-spacing );text-align: var(--text-align)\">\u00a0 Senior management must also be \u00a0<\/span><span style=\"color: var( --e-global-color-text );font-family: var( --e-global-typography-text-font-family ), Sans-serif;font-size: var( --e-global-typography-text-font-size );letter-spacing: var( --e-global-typography-text-letter-spacing );text-align: var(--text-align);font-weight: bolder\">continuously involved in monitoring of ICT risk management<\/span><span style=\"color: var( --e-global-color-text );font-family: var( --e-global-typography-text-font-family ), Sans-serif;font-size: var( --e-global-typography-text-font-size );font-weight: var( --e-global-typography-text-font-weight );letter-spacing: var( --e-global-typography-text-letter-spacing );text-align: var(--text-align)\">\u00a0<\/span>and has a duty to actively contribute to the overall digital operational resilience strategy.<\/p>\n<p class=\"translation-block\">The approach of senior management should go beyond simply ensuring the resilience of ICT systems. It should then also focus on the company's employees and processes through internal policies.
