Nicm\u00e9n\u011b ani p\u0159\u00edsn\u00e1 regulace nemus\u00ed automobilky donutit k\u00a0tomu, aby se v\u00a0tomto ohledu chovaly odpov\u011bdn\u011b. Rizika spojen\u00e1 s\u00a0ochranou soukrom\u00ed a \u00fadaj\u016f nast\u00ednil Evropsk\u00fd sbor pro ochranu osobn\u00edch \u00fadaj\u016f (EDPB)<\/em><a href=\"https:\/\/edpb.europa.eu\/system\/files\/2021-08\/edpb_guidelines_202001_connected_vehicles_v2.0_adopted_cs.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>[3]<\/em><\/a><em> ji\u017e v\u00a0roce 2020, mj. pokud jde o absenci souhlas\u016f v\u00a0p\u0159\u00edpad\u011b n\u00e1sledn\u00e9ho zpracov\u00e1n\u00ed, maskov\u00e1n\u00ed \u00fa\u010del\u016f zpracov\u00e1n\u00ed jako nezbytn\u011b nutn\u00fdch k\u00a0poskytov\u00e1n\u00ed slu\u017eeb s\u00a0c\u00edlem se souhlas\u016fm vyhnout nebo zakomponov\u00e1n\u00ed souhlas\u016f do smluv o koupi nebo pron\u00e1jmu automobilu, zpracov\u00e1n\u00ed citliv\u00fdch \u00fadaj\u016f (biometrick\u00e9 \u00fadaje, n\u00e1bo\u017eensk\u00e9 vyzn\u00e1n\u00ed \u010di sexu\u00e1ln\u00ed orientaci) a \u00fadaj\u016f odhaluj\u00edc\u00edch trestn\u00e9 \u010diny nebo p\u0159estupky, kter\u00e9 si vy\u017eaduj\u00ed p\u0159\u00edsnej\u0161\u00ed podm\u00ednky zpracov\u00e1n\u00ed, netransparentn\u00ed informov\u00e1n\u00ed, problematika informov\u00e1n\u00ed spolucestuj\u00edc\u00edch v\u00a0aut\u011b, p\u0159ed\u00e1v\u00e1n\u00ed dat do t\u0159et\u00edch zem\u00ed, t\u0159eba i pr\u00e1v\u011b do USA.<\/em>]<\/p>\n\n\n\n<p id=\"ember42\">Automobilky se ji\u017e l\u00e9ta chlub\u00ed, \u017ee jejich auta jsou sp\u00ed\u0161e s<strong>ofistikovan\u00fdmi po\u010d\u00edta\u010di na kolech<\/strong>, ne\u017e klasick\u00fdm dopravn\u00edm prost\u0159edkem.<a href=\"https:\/\/www.latimes.com\/business\/autos\/la-fi-hy-musk-computer-on-wheels-20150319-story.html\" target=\"_blank\" rel=\"noreferrer noopener\">[4]<\/a> Auto\u0159i \u010dl\u00e1nku zmi\u0148uj\u00ed n\u011bkolik probl\u00e9mov\u00fdch oblast\u00ed spojen\u00fdch s\u00a0auty. <strong>Auta sb\u00edraj\u00ed daleko v\u00edce dat<\/strong>, ne\u017e ke sv\u00e9mu provozu pot\u0159ebuj\u00ed (vlastn\u011b ve\u0161ker\u00e1 dostupn\u00e1 data \u2013 \u010d\u00edm lep\u0161\u00ed v\u00fdbavu a\u00a0senzory si koup\u00edte, t\u00edm v\u00edce o v\u00e1s toho automobilka zjist\u00ed a prod\u00e1), v\u011bt\u0161ina automobilek (84% ze\u00a0zkouman\u00fdch) m\u016f\u017ee va\u0161e data prod\u00e1vat a v\u011bt\u0161ina automobilek (92% ze zkouman\u00fdch) <strong>d\u00e1v\u00e1 \u0159idi\u010d\u016fm malou a\u017e \u017e\u00e1dnou kontrolu nad t\u00edm, jak je s\u00a0jejich daty nakl\u00e1d\u00e1no<\/strong>. Vzhledem k\u00a0tomu, \u017ee \u0159idi\u010di si auto kupuj\u00ed, je\u00a0p\u0159\u00edstup automobilek ke sb\u011bru dat dal\u0161\u00edm zp\u016fsobem, jak z\u00a0nich vyt\u00e1hnout pen\u00edze. Vzhledem ke\u00a0shodn\u00e9mu p\u0159\u00edstupu prakticky v\u0161ech automobilek bez mo\u017enosti obrany.<\/p>\n\n\n\n<p id=\"ember43\"><strong>A jak\u00e1 data automobilky sb\u00edraj\u00ed?<\/strong> [<em>Jednodu\u0161\u0161\u00ed by mo\u017en\u00e1 bylo \u0159\u00edci, jak\u00e1 nesb\u00edraj\u00ed\u2026<\/em>] Mezi 28 analyzovan\u00fdmi automobilkami jsou i takov\u00e9, kter\u00e9 dle sv\u00e9 vlastn\u00ed dokumentace sb\u00edraj\u00ed <strong>informace o sexu\u00e1ln\u00ed aktivit\u011b \u0159idi\u010d\u016f<\/strong> (Nissan), <strong>o genetick\u00fdch informac\u00edch, hladin\u011b stresu, o tom, kolik pen\u011bz vyd\u011bl\u00e1v\u00e1te<\/strong>\u2026 Tato data jsou extr\u00e9mn\u00edmi v\u00fdst\u0159elky nad r\u00e1mec va\u0161eho jm\u00e9na, kontakt\u016f, adresy, cest, kter\u00e9 vozem absolvujete a dal\u0161\u00edch, kter\u00e9 byste asi o\u010dek\u00e1vali.<\/p>\n\n\n\n<p id=\"ember44\"><strong>Jak\u00e9 mo\u017enosti automobilka \u0159idi\u010d\u016fm v&nbsp;souladu s&nbsp;ochranou jejich dat a osobn\u00edch \u00fadaj\u016f d\u00e1v\u00e1? <\/strong>Z&nbsp;28&nbsp;zkouman\u00fdch jen 2 umo\u017e\u0148uj\u00ed vymazat osobn\u00ed data \u0159idi\u010de. U ostatn\u00edch tato mo\u017enost prost\u011b neexistuje. Nadto automobilky ve sv\u00fdch dokumentac\u00edch neuv\u00e1d\u00ed, zda jsou \u201edata at rest\u201c ulo\u017een\u00e1 ve voze \u0161ifrov\u00e1na. Odpov\u011b\u010f nebyla v\u00fdzkumn\u00edk\u016fm z\u0159ejm\u00e1 ani z&nbsp;t\u011bch m\u00e1la odpov\u011bd\u00ed, kter\u00e9 jim automobilky na tuto ot\u00e1zku doru\u010dily. To&nbsp;je&nbsp;vzhledem k&nbsp;dosavadn\u00ed nevaln\u00e9 historii zabezpe\u010den\u00ed dat probl\u00e9m \u2013 nap\u0159. Volskwagen sd\u011blil, \u017ee mezi srpnem 2019 a kv\u011btnem 2021 byla on-line k&nbsp;dispozici data o jeho 3,3 milionech z\u00e1kazn\u00edk\u016f.<\/p>\n\n\n\n<p id=\"ember45\"><strong>A co automobilky s\u00a0daty a osobn\u00edmi \u00fadaji d\u011blaj\u00ed?<\/strong> V\u00a0dokumentac\u00edch je mo\u017eno se do\u010d\u00edst, \u017ee je mohou vyu\u017e\u00edvat ke zlep\u0161en\u00ed sv\u00fdch slu\u017eeb i je prodat d\u00e1l. Jedna ze spole\u010dnost\u00ed, kter\u00e1 tyto data kupuje je nap\u0159\u00edklad High Mobility<a href=\"https:\/\/www.high-mobility.com\/\" target=\"_blank\" rel=\"noreferrer noopener\">[5]<\/a>. Jestli a komu je p\u0159eprod\u00e1v\u00e1 d\u00e1l nen\u00ed ve\u0159ejn\u00e1 informace.<\/p>\n\n\n\n<p id=\"ember46\">\u010cl\u00e1nek je uzav\u0159en t\u00edm, \u017ee <strong>\u017e\u00e1dn\u00e1 z\u00a0automobilek nepro\u0161la testy <\/strong>Mozilla Foundation a v\u0161echny byly ocen\u011bny zn\u00e1mkou <strong><em>\u201ePrivacy not included\u201c<\/em><\/strong><em> \u2013 \u201eSoukrom\u00ed nezaru\u010deno\u201c. N\u011bkter\u00e9 byly hor\u0161\u00ed ne\u017e jin\u00e9, v\u0161echny ale byly \u0161patn\u00e9. [P\u0159ipom\u00edn\u00e1me, \u017ee praxe v\u00a0Evrop\u011b m\u016f\u017ee b\u00fdt oproti v\u00a0\u010dl\u00e1nku popsan\u00fdm postup\u016fm rozd\u00edln\u00e1, by\u0165 zku\u0161enosti tomu neodpov\u00eddaj\u00ed. Informovalo v\u00e1s auto, jak\u00e9 \u00fadaje o v\u00e1s zpracov\u00e1v\u00e1? Mnoho d\u016fvod\u016f pro rozd\u00edln\u00e9 postupy tak nenach\u00e1z\u00edme. Jedin\u00fdmi rozd\u00edly je robustn\u011bj\u0161\u00ed pr\u00e1vn\u00ed regulace ochrany osobn\u00edch \u00fadaj\u016f a dat v\u00a0EU. Ta je v\u0161ak ne v\u017edy zcela vym\u00e1h\u00e1na. Zvl\u00e1\u0161t\u011b v\u00a0p\u0159\u00edpad\u011b automotive to m\u016f\u017ee b\u00fdt z\u00a0hlediska jeho postaven\u00ed v\u00a0r\u00e1mci evropsk\u00e9ho hospod\u00e1\u0159stv\u00ed ne zcela \u017e\u00e1douc\u00ed.
