The agency doesn\u2019t need to know every detail of your business to do so. List both the core and secondary services your organisation actually provides. Contracts, product sheets, your website, price lists, an internal service catalogue or invoicing records can all help. For each service, note down:<\/p><ul><li>what exactly you provide to the customer or user,<\/li><li>who uses the service and in which territory,<\/li><li>which legal entity provides it under contract,<\/li><li>whether it is your own service or merely support for another company in the group,<\/li><li>how essential the service is to your customers\u2019 operations or to the public.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-176a5f3 elementor-alert-warning elementor-widget elementor-widget-alert\" data-id=\"176a5f3\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">A common mistake is to assess only the company\u2019s main line of business. A secondary or narrowly defined service that doesn\u2019t look central to the business at first glance may still fall under the Act. What matters is whether the law classifies it as a regulated service.<\/span>\n\t\t\t\n\t\t\t\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7b9ed12 elementor-widget elementor-widget-heading\" data-id=\"7b9ed12\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">2. Compare your services against the decree on regulated services<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e1b4d09 elementor-widget elementor-widget-text-editor\" data-id=\"e1b4d09\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The new Act works with specific <a href=\"https:\/\/cybrela.com\/en\/regulated-services-cyber-security-act\/\"><strong>regulated services<\/strong><\/a> in individual sectors. A conclusion like \u201cwe\u2019re a manufacturing company\u201d or \u201cwe work in IT\u201d therefore isn\u2019t enough. Check the size of your organisation and other conditions<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6d2432a elementor-widget elementor-widget-text-editor\" data-id=\"6d2432a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>For many regulated services, the size of the enterprise is decisive. <strong>But it isn\u2019t always just about the headcount of a single company<\/strong>. Financial thresholds and relationships with partner or linked enterprises may also come into the calculation. If you\u2019re part of a group, bring in someone who understands the ownership structure and can provide the figures you need.<\/p><p>Some services also have criteria of their own. These may include the number of users, the scope of the service, the provider\u2019s special status, or the fact that the service can\u2019t easily be replaced.<strong> So assess each service against the rules that apply specifically to it<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-706e48a elementor-widget elementor-widget-heading\" data-id=\"706e48a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">4. Determine your regime of obligations<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b762b1d elementor-widget elementor-widget-text-editor\" data-id=\"b762b1d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tIf you provide a regulated service, the decree also determines whether you fall under the higher-tier or lower-tier regime of obligations. <strong>Organisations don\u2019t get to choose their regime<\/strong>. It depends on the specific service, the size of the organisation and other criteria. \n\nIf you provide several regulated services and at least one of them falls under the higher-tier regime, the higher-tier regime applies to the whole organisation. That\u2019s why it\u2019s important not to stop the assessment at the first service you identify. Document your conclusion so it can be traced back<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-632309f elementor-widget elementor-widget-text-editor\" data-id=\"632309f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Whether you conclude that you must register a regulated service or that the Act doesn\u2019t apply to you, <strong>keep the supporting documents and the reasoning behind your decision<\/strong>. A short internal record should state the services assessed, the criteria applied, the data sources, the outcome and the date of the assessment.<\/p><p>A record like this will help you both when replying to N\u00daKIB and later on, if your activities, the size of your organisation or your group structure change.
