Tedy jak podrobnou dokumentaci bude pot\u0159ebovat, jestli mu posta\u010d\u00ed intern\u00ed posouzen\u00ed, nebo bude muset zapojit t\u0159et\u00ed stranu \u010di vyu\u017e\u00edt evropsk\u00e9 certifika\u010dn\u00ed sch\u00e9ma. Pr\u00e1v\u011b od t\u011bchto produkt\u016f se toti\u017e odv\u00edjej\u00ed jednotliv\u00e9 povinnosti. Pokud spole\u010dnost takov\u00fd produkt nevyr\u00e1b\u00ed, neimportuje ani nedod\u00e1v\u00e1, CRA se na ni typicky nevztahuje. O co tedy jde?<\/p><p>Definice produkt\u016f s digit\u00e1ln\u00edmi prvky je pom\u011brn\u011b obecn\u00e1. Zjednodu\u0161en\u011b jde o<strong> software nebo hardware, kter\u00fd je p\u0159\u00edmo \u010di nep\u0159\u00edmo datov\u011b propojen\u00fd s jin\u00fdm za\u0159\u00edzen\u00edm nebo s\u00edt\u00ed<\/strong>. M\u016f\u017ee j\u00edt o samostatn\u00fd softwarov\u00fd produkt, fyzick\u00e9 za\u0159\u00edzen\u00ed se softwarem, IoT za\u0159\u00edzen\u00ed, ale tak\u00e9 o softwarovou nebo hardwarovou komponentu, pokud se na trh uv\u00e1d\u00ed samostatn\u011b.<\/p><p>Pro posouzen\u00ed je relevantn\u00ed tak\u00e9 to, jestli produkt <strong>vyu\u017e\u00edv\u00e1 tzv. funkci pro vzd\u00e1len\u00e9 zpracov\u00e1n\u00ed dat<\/strong>, nap\u0159\u00edklad cloudovou \u010d\u00e1st slu\u017eby. To plat\u00ed v p\u0159\u00edpad\u011b, kdy je tato funkce nezbytn\u00e1 pro n\u011bkterou z funkc\u00ed produktu a navrhl ji v\u00fdrobce. Produkt s digit\u00e1ln\u00edmi prvky tedy nemus\u00ed b\u00fdt jen samostatn\u00e9 fyzick\u00e9 za\u0159\u00edzen\u00ed nebo aplikace v u\u017e\u0161\u00edm slova smyslu. \u010casto p\u016fjde o<strong> \u0161ir\u0161\u00ed \u0159e\u0161en\u00ed<\/strong>, ve kter\u00e9m spolu funguje hardware, software, mobiln\u00ed nebo webov\u00e1 aplikace, vzd\u00e1len\u00e1 spr\u00e1va \u010di cloudov\u00e9 rozhran\u00ed.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-55ded10 elementor-alert-warning elementor-widget elementor-widget-alert\" data-id=\"55ded10\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"alert.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<div class=\"elementor-alert\" role=\"alert\">\n\n\t\t\t\n\t\t\t\t\t\t<span class=\"elementor-alert-description\">Jedn\u00edm z kl\u00ed\u010dov\u00fdch znak\u016f produktu s digit\u00e1ln\u00edmi prvky je datov\u00e9 propojen\u00ed. Pokud je produkt p\u0159i sv\u00e9m zam\u00fd\u0161len\u00e9m nebo b\u011b\u017en\u011b p\u0159edv\u00eddateln\u00e9m pou\u017eit\u00ed propojen\u00fd s jin\u00fdm za\u0159\u00edzen\u00edm nebo s\u00edt\u00ed, a\u0165 u\u017e p\u0159\u00edmo, nebo nep\u0159\u00edmo, m\u016f\u017ee spadat pod CRA.<\/span>\n\t\t\t\n\t\t\t\n\t\t<\/div>\n\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0ff8540 elementor-widget elementor-widget-text-editor\" data-id=\"0ff8540\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>CRA se ale z\u00e1m\u011brn\u011b <strong>nevztahuje na v\u0161echny produkty s digit\u00e1ln\u00edmi prvky<\/strong>. Vylou\u010deny jsou ty produkty, pro kter\u00e9 u\u017e plat\u00ed vlastn\u00ed odv\u011btvov\u00e9 p\u0159edpisy EU. C\u00edlem je vyhnout se zdvojen\u00fdm pravidl\u016fm a p\u0159ekryv\u016fm regulac\u00ed. Konkr\u00e9tn\u011b se CRA neaplikuje nap\u0159\u00edklad na zdravotnick\u00e9 prost\u0159edky a diagnostick\u00e9 zdravotnick\u00e9 prost\u0159edky in vitro, motorov\u00e1 vozidla a jejich sou\u010d\u00e1sti spadaj\u00edc\u00ed pod na\u0159\u00edzen\u00ed o obecn\u00e9 bezpe\u010dnosti vozidel, n\u011bkter\u00e9 certifikovan\u00e9 produkty civiln\u00edho letectv\u00ed nebo lodn\u00ed v\u00fdstroj.<\/p>\n<p>Krom\u011b t\u011bchto sektorov\u00fdch v\u00fdjimek CRA <strong>nedopad\u00e1 ani na produkty vyvinut\u00e9 nebo upraven\u00e9 v\u00fdhradn\u011b pro \u00fa\u010dely n\u00e1rodn\u00ed bezpe\u010dnosti<\/strong> nebo obrany, p\u0159\u00edpadn\u011b na produkty ur\u010den\u00e9 ke zpracov\u00e1n\u00ed utajovan\u00fdch informac\u00ed. Vylou\u010deny jsou i n\u00e1hradn\u00ed d\u00edly ur\u010den\u00e9 k nahrazen\u00ed toto\u017en\u00fdch komponent vyroben\u00fdch podle stejn\u00fdch specifikac\u00ed. Pokud v\u00e1\u0161 produkt spad\u00e1 do n\u011bkter\u00e9 z t\u011bchto kategori\u00ed, povinnosti z CRA se na n\u011bj nevztahuj\u00ed. Pr\u00e1v\u011b za\u0159azen\u00ed do spr\u00e1vn\u00e9 kategorie pak ur\u010duje, jak\u00e9 povinnosti se na produkt budou vztahovat a<b> jak n\u00e1ro\u010dn\u00e9 bude prok\u00e1z\u00e1n\u00ed shody<\/b>.
