Typically, this includes data from connected devices, machines, vehicles, or software platforms \u2013 essentially anywhere a device collects and automatically transmits data as part of normal operation.<\/p><p class=\"translation-block\">The regulation applies to <strong>manufacturers of smart devices, providers of digital services<\/strong>, and companies that further process such data \u2013 for example, by analyzing it, using it for maintenance, operational optimization, or developing related services. It also affects companies that <strong>do not develop smart devices themselves but actively use them<\/strong>.<\/p><p class=\"translation-block\">At the same time, the Data Act significantly strengthens the rights of users of connected devices, particularly <strong>IoT products<\/strong>. Users now gain:<\/p><ul><li>the right to access the data generated by their devices, and<\/li><li>greater control over whether and with whom that data is shared \u2013 for example, service partners, software vendors, or application developers.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ac9ba80 elementor-blockquote--skin-boxed elementor-blockquote--align-center elementor-widget elementor-widget-blockquote\" data-id=\"ac9ba80\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"blockquote.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<blockquote class=\"elementor-blockquote\">\n\t\t\t<p class=\"elementor-blockquote__content\">\n\t\t\t\tFor companies, this means clearly understanding what data their products generate, who owns that data, and how access will be granted. Companies must provide access to data in a commonly used, structured, and machine-readable format so that authorized parties can actually work with it \u2013 not merely view it. Data must also be shared under <strong>fair, reasonable<\/strong>, and non-discriminatory conditions, without favoring selected partners or the provider\u2019s own services.<\/p><p class=\"translation-block\">In practice, this is not only about technical settings or interfaces. The Data Act also affects <strong>contractual relationships, terms and conditions, and internal processes<\/strong>. If disclosure could cause significant economic harm or jeopardize trade secrets, the regulation allows companies to <strong>refuse to share such data<\/strong>.<\/p><p>However, this is not a blanket exemption. The decision must be properly justified, documented, and in some cases reported to the competent authority.
